I intend to volunteer or participate in an Active Heroes Retreat visit or event “Event” (on behalf of or otherwise in the name of Active Heroes Inc. (“Active Heroes”). I acknowledge that I knowingly represent that I am medically able to participate in this Event without injury, death, or property loss/damage. Having read this waiver and knowing these facts and in consideration of your accepting my participation in the Event at 1022 Ridgeview Dr. Shepherdsville, Kentucky, I, intending to be legally bound, do hereby for myself, my heirs, my executors, and administrators agree as follows:

I do waive and forever release all rights and claims for any damages and liabilities of any kind arising out of my participation in the Event against all persons, entities, and agencies involved with promoting the Event; and their respective agents, successors, representatives, and assignees even though that liability may arise out of negligence or carelessness on the part of the persons names in this waiver.

I ASSUME THE RISKS OF MYSELF AND MY DEPENDENTS PARTICIPATING IN THE EVENT, including, but not limited to, all bodily injuries, including death resulting therefrom, and personal injuries to me and damage to and loss of my property, including loss of use thereof and any other indirect or consequential damages, resulting directly or indirectly, wholly or in part, from my participation in the Event, from contact with other participants, negligence or wrongful acts of myself or any other person or entity, any defects or condition of premises, the effects of the weather including high heat, cold temperatures, storms and/or humidity, and while traveling to and from the Event.

I hereby agree to indemnify and hold harmless Active Heroes, including its affiliates, successors, assignees, officers, directors, agents, employees, team leaders volunteers, and vendors, from and against any and all claims, expenses, losses, liabilities, including attorney fees, for injury, death, partial or permanent disability, property loss/damage, economic loss, medical or hospital bills, theft or damages of any kind, arising out of, relating to or incurred in any way whatsoever as a result of my participation in and travel to and from the Event, including but not limited to any injury, death, loss/damage caused by negligence or wrongful acts of myself, or my omissions to act, or any other person or entity. I AGREE NOT TO SUE AND INDEMNIFY AND HOLD HARMLESS ANY, AND ALL OF THE ENTITIES AND PERSONS MENTIONED IN THIS PARAGRAPH for all the claims, expenses, losses, and liabilities that I have waived, released, or discharged herein.

If the participant is a person under 18 years of age, the undersigned parent or legal guardian of the participant agrees to indemnify, defend, and hold harmless Active Heroes, including its affiliates, successors, assignees, officers, directors, agents, employees, team leaders, volunteers, and vendors from and against all claims, liabilities, losses, damages, costs, expenses (including attorney’s fees), judgments, and penalties arising out of the participant’s participation in the Event.

I agree that Active Heroes is not responsible for any personal items or property that are lost, stolen, stained or damaged at or during the event.

I consent to emergency medical care and transportation to obtain treatment in the event of injury to me as medical professionals may deem appropriate. This Release, Indemnity & Hold Harmless Agreement extends to any liability arising out of, or in any way connected with, the medical treatment and transportation provided in the event of an emergency.

I additionally acknowledge and agree to abide by the competitive rules adopted for the Event and agree that prior to participating in the Event, I will inspect the course, facilities, equipment, and areas to be used on my own behalf as I deem appropriate and if I believe any to be unsafe that I will advise the person supervising the Event, course, facilities, equipment, or area. I hereby ACKNOWLEDGE AND GRANT PERMISSION for the use of my name and/or likeness, in print, video or film, relating to my participation in event(s), and I waive all right to any future compensation to which I may otherwise be entitled because of the use of my likeness regarding promotional and/or advertising materials.

Event Fees Acknowledgement (if applicable) I understand and agree that if entry fees are collected, they are nonrefundable and nontransferable. Further, I acknowledge and agree that Active Heroes, in its sole discretion, may delay or cancel the Event if it believes the conditions on the day are unsafe. If the Event is delayed or cancelled for any reason, including, but not limited to: fire, threatened or actual strike, protest, labor difficulty, work stoppage, insurrection, war, public disaster, flood, unavoidable casualty, acts of God or the elements (including without limitation, rain, snow, ice, hail, high winds, thunderstorm, lightening, tornado, earthquake), or any other cause beyond the control of the Active Heroes, there shall be no refund of the entry fee or any other costs of the participant in connection with the Event. I have read and understand this document and agree to be bound by the same.
